The joint sitting of the Regional Policy and Self-Government and the Human Rights and Civil Integration Committees

The Committees discussed the Bill on Spatial Planning, Architectural and Construction Activity Code, introduced by the Chair of the Environmental Committee, Maia Bitadze.

The Bill envisages the set of the constructed facilities to operate and allows the owners of the facilities to register their property not as “under construction” but as “constructed”.

Besides, the owners will have the opportunity to, at their discretion, develop their property, including establishing the homeowners association. The Bill prohibits the supply of the facility with energy and natural gas prior to the set to operate and issue of the respective legal act.

“Besides, the construction supervision body will be entitled to set the construction to operation accomplished before August 18, 2020, with or without the permit within Tbilisi, though included in the detailed plan. At that, the persons within Tbilisi administrative borders shall be exempted from forfeitures for violation of the state privatization terms if these liabilities should be fulfilled on the territory where the facility stipulated under the Spatial Planning, Architectural and Construction Activity Code and the Free Circulation Code is located”, - the reporter added.

The persons shall be exempted from the fines, penalties and indemnification to the state, who have committed the respective administrative offense before August 18, 2020.

MPs expressed their positions.

According to the Chair of the Human Rights Committee, Mikheil Sarjveladze, this problem has been unregulated for years. “It can serve a good start for stricter approaches. I understand the differentiation for Tbilisi, though we will issue additional recommendations”.

The Committee considers that the term after August 18 can also be provided and the list of energy and gas can be supplemented by water.

“We shall also specify that as the 2-year period is considered for the application, the relations shall also be regulated that can emerge during these 2 years. I offer to establish the moratorium, though when it is about the inevitable risk of destruction, the people shall not wait for 2 years”, - he added.

According to the Chair of the Regional Policy, Sozar Subari, it is a complicated Bill as concerns the fate of many people. “It has its pros and cons and we shall carefully discuss – what this Bill provides more – positive or negative”.

The reporter answered the questions and the Committees approved the Bill providing the reservations and remarks.
